It is perplexing for me, as a tax lawyer having worked for close to 10 years on Ethiopian tax laws, to see how the investment and finance community in Ethiopia is not worrying enough about the tax on premiums “introduced” recently by the Ministry of Finance. It is perplexing because this “newly introduced” tax is unclear on many fronts, and anyone who has had any engagements with the Ethiopian Tax Authorities knows how the tax administration is beset by the problem of misapplication of even some of the well-articulated tax laws let alone those with uncertainties. The obscurity of the relevant law at issue is not only for the ordinary taxpayer, but also for the tax authority and, surprisingly enough, even to the Ministry of Finance (i.e. the very authority that “introduced” the tax) as will be shown below.

When is the law requires the taxpayer to declare income tax?

The author wants to conclude the above discussion with the following remarks. Hamile is opted for two reasons. One, Hamile has got an established acceptance among taxpayers as a time when their tax year comes to an end. Second, lack of awareness as to the relevant legislation both by the authorities and taxpayers. Still clearly determining the exact time depends on individual circumstances of taxpayers, it can’t be done in one basket treatment. Authorities should abstain from rushing to penalize taxpayers for late payment without considering the exact tax year or financial year of taxpayers. Further, the time of payment is an important element to have the business license renewed. Possible consistency should be maintained between taxing authorities and the trade office.

ለዚህ ጽሑፍ መነሻ የሆነኝ በመዝገብ ቁጥር 78398 በአቶ ሽፈራዉ ደጀኔ እና ወ/ሮ ጸሀይ ተስፋዬ በአንድ በኩልና በአቶ ሲሳይ አበቡ በሌላ በኩል በተደረገ ሙግት የፌዴራል ጠቅላይ ፍርድ ቤት ሰበር ችሎት ጥቅምት 19 2005 የሰጠዉ ዉሳኔ ነዉ፡፡

በመደምደሚያው

1. የፓሮል ሕግ የሚሉትና በተለይ የአንግሎ-አሜሪካን የሕግ ስልትን የሚከተሉ ሀገሮች እዉቅና የሚሰጡት በኢትዮጲያ ሕግ የለም፡፡በኢትዮጲያ የዉል ሕግ መሰረት፤ ሕጉ ወይም ተዋዋይ ወገኖች የተለየ ፎርም ካላስቀመጡ በስተቀር፤ ዉልን በማንኛዉም ፎርም በተደረገ ስምምነት ማሻሻልና መጨመር ይቻላል፡፡ ሕጉ ወይም ተዋዋይ ወገኖች የተለየ ፎርም ካስቀመጡ ግን፤ ዉሉ ሊሻሻል ወይም ሊጨመርበት የሚችለዉ በተመሳሳይ ፎርም በተደረገ ስምምነት ነዉ፡፡

2. የፍ/ብ/ሕ/ቁጥር 2005ና 2006 የተቀመጡት ድንጋጌዎች የማስረጃ ድንጋጌዎች በመሆናቸዉ ስራ ላይ የሚዉሉት በsubstantive ሕጉ የተቀመጡትን ድንጋጌዎች በማይሸረሽር መልኩ መሆን አለበት፡፡

3. ሰበር ሰሚ ችሎቱ የቤቱ ባለቤቶች ቤቱን በአርባ ሺ እንዲሸጡ ይገደዳሉ ያለዉ ምንም የሕግ መሰረት የሌለዉ ነዉ፡፡

4. ሰበር ሰሚ ችሎቱ ዉሉ ዋጋ የለዉም ብቻ ሳይሆን በእርግጥ በጽሁፉ እንደተገለጸዉ ሃያ ሺ ብር ተከፍሏል የሚለዉን በተጨማሪ ማስረጃ በመፈተሸ የተከፈለ ብር ካለ እንዲመለስ ማዘዝ ይኖርበታል፤ ወይም ይህን ጠቁሞ ጉዳዮን ለታችኛዉ ፍርድ ቤት መምራት ይገባዉ ነበር፡፡

5. ሰበር ሰሚ ችሎቱ ይህን አጋጣሚ በመጠቀም የ2005ና 2006ን በተመለከተ የማብራሪያ/አሳማኝ ትርጉም (obiter dictum) ሊሰጥ እየቻለ እድሉና አሳልፏል፡፡
